1. Acceptance of Terms

By accessing or using the BybitFX platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and BybitFX Ltd. ("BybitFX", "we", "us", or "our").

2. Eligibility

To use the Service you must:

• Be at least 18 years of age or the legal age of majority in your jurisdiction.
• Not be a resident of a prohibited jurisdiction (see Section 3).
• Not be on any government or regulatory blacklist or sanctions list.
• Have the legal authority to enter into these Terms on behalf of yourself or any entity you represent.

3. Restricted Jurisdictions

The Service is not available to residents or nationals of the United States, North Korea, Iran, Cuba, Syria, or any other jurisdiction prohibited by applicable law or where providing such services would require local licensing that BybitFX has not obtained. We reserve the right to restrict access from additional jurisdictions at any time.

4. Account Registration

When registering an account you agree to:

• Provide accurate, current, and complete information.
• Maintain and promptly update your registration information.
• Keep your password confidential and not share it with any third party.
• Notify us immediately of any unauthorised use of your account.
• Be solely responsible for all activities that occur under your account.

We reserve the right to refuse registration, suspend, or terminate accounts at our sole discretion.

5. Trading Services

BybitFX provides cryptocurrency spot and derivatives (futures/contract) trading services. By using these services you acknowledge:

• Cryptocurrency markets are highly volatile, and you may lose all or a portion of your invested funds.
• Leveraged and futures trading amplifies both gains and losses and carries an extremely high risk.
• Past performance of any cryptocurrency or trading strategy does not guarantee future results.
• You are solely responsible for all trading decisions made through the platform.
• BybitFX does not provide investment advice or recommendations of any kind.

6. Fees

BybitFX charges trading fees as displayed on the platform at the time of order placement. We reserve the right to change fee structures with reasonable notice. All fees are deducted automatically from the relevant balance at the time of execution.

7. Prohibited Conduct

You must not:

• Use the Service for money laundering, terrorism financing, or any other illegal purpose.
• Manipulate markets or engage in wash trading, spoofing, layering, or any form of market abuse.
• Circumvent any technical or security measures of the platform.
• Use automated trading bots without prior written approval from BybitFX.
• Post or transmit any content that is unlawful, fraudulent, or harmful.

Violation of any prohibited conduct may result in immediate account suspension or termination and may be reported to relevant authorities.

8. Risk Disclosure

Cryptocurrency trading involves significant risk. The value of digital assets can drop to zero. Futures and leveraged products may result in losses exceeding the initial deposit. You should not trade with funds you cannot afford to lose. BybitFX strongly recommends seeking independent financial, legal, and tax advice before trading.

9. Intellectual Property

All content on the BybitFX platform, including but not limited to text, graphics, logos, icons, images, and software, is the property of BybitFX Ltd. or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. BybitFX DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BybitFX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS, REGARDLESS OF WHETHER BybitFX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify, defend, and hold harmless BybitFX, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Cayman Islands, without regard to conflict of law principles. Any disputes arising out of or in connection with these Terms shall be resolved through binding arbitration conducted under the rules of the Hong Kong International Arbitration Centre (HKIAC).

14. Changes to Terms

We may modify these Terms at any time by posting the revised Terms on the platform. Your continued use of the Service after such changes constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the Service.
